Bongikosi Khanyile still awaits sentencing

Although he expected his sentencing today however things went South, Bonginkosi Khanyile appeared before the Durban Magistrate Court today for his sentencing after the court found him guilty of public violence, failing to comply with Police instruction and being found in possession of a slingshot in September 2016.

 

As expected, the EFF student command came to court in numbers, alongside the leadership of SASCO under the ANC. Mangosuthu University of Technology (MUT) SASCO President Sandile Dlamini was also there to support the friend and former comrade. Bonginkosi was late for his sentencing and it was said that the case is then postponed to 12 November this year due to unfinished reports that his legal representative had asked for.

A few minutes just when people were making their way out of the court, Khanyile arrived in the company of his mother, he waited 90 minutes before the court sat in.

In the second sitting, the Magistrate told Bonginkosi that the reports from both prosecution and the correctional services are not yet complete so his sentencing is postponed till 28 January 2019; this is because his Advocate will only be available then.

“I’ve been waiting in fear for this day but I understand that there’s no other way, but I want to say this to the court that I’m getting thinner each day because this thing is eating me out, I don’t know whether I will be jail on the 28th or out as you would that I am a student and I’m currently looking for employment and I don’t know whether what the future holds for me. I am hurt by all this magistrate but I understand there’s nothing that can be done but I do hope that you will finalise everthing on the 28th and I will be a free man”. Said Bonginkosi.

Bonginkosi is expected to appear for his sentencing before the Durban Magistrate Court on the 28TH January 2019.
